Civil Case Between Family Members Dismissed
March 2025
We received a dismissal of a civil case which involved the sad fact of a Plaintiff suing other family members. It was resolved after two and 1/2 years. Although it was a dismissal, it was a victory for our clients who suffered tremendously during this lawsuit. The family member who sued our clients had no standing to sue, it turned out, because Plaintiff failed to state the claim in a bankruptcy filing. Although the bankruptcy trustee intervened in the case and engaged in some dirty dealings to cover their own mistakes in the Plaintiff's bankruptcy, we held the course resolved to win. Sometimes winning comes in the form of a walk away. Sometimes your opponent knows when they are beaten!
We received the following message after delivering the news to our client that the Bankruptcy Court dropped its claim against them for someone else's debts:
"Thank you for taking on our case and standing by us through what has been an incredibly difficult two and a half years.
Your steady guidance helped us navigate a legal situation we never expected and didn't know how to handle. We're especially grateful for your thoughtful approach, your continued focus on the law and how it protects us.
We also deeply appreciate your willingness to continue defending us in what turned out to be a complex and challenging case—and for being mindful of our financial limitations throughout the process. Your support helped keep this lawsuit from becoming an even heavier burden.
With sincere thanks,"
