Judgment Quieting Title and Returning Real Property to Rightful Owner

Our clients learned that they were the co-trustees of a trust a family member had created for the benefit of his great-grandchildren after they received notice of an impending foreclosure on several real properties in Dallas County due to unpaid taxes that dated back several years.  Our clients' original attorney discovered that the properties were transferred to unregistered entities, and that the address and the common thread between the properties was the attorney who drafted the original trust documents and was a family friend.  The attorney who drafted the trust transferred the properties to fictional entities and then didn't pay the taxes. After nearly a year-long legal battle, all but one of the properties was returned to the trust.  This case highlights the need for reforming real estate law in Texas. It was just too easy for that crooked attorney, who can no longer practice, to do what he did. This case also underscored the necessity for improvements in how we care for the physical health, safety, and rights of our elderly community.
